1. Account Rules

1.1 Account Creation

• You must be at least 13 years old to create an account.
• You must provide accurate, current, and complete information during registration.
• You are responsible for maintaining the confidentiality of your account credentials.
• You may not share your account with third parties or create multiple accounts to abuse promotional offers.
• Each account may hold multiple services but belongs to one individual or legal entity.

1.2 Account Responsibility

You are solely responsible for all activity that occurs under your account, including any content hosted, applications run, or users granted access to your server. XyleHosting is not responsible for unauthorized access resulting from your failure to protect your credentials.

2. Acceptable Usage

Our services are provided for lawful purposes only. The following activities are strictly prohibited:

• Hosting or distributing illegal content, including copyright-infringing material, CSAM, or malware
• Launching or facilitating DDoS attacks, port scanning, or network abuse against any target
• Sending unsolicited bulk email (spam) or engaging in phishing campaigns
• Mining cryptocurrency without prior written approval
• Reselling services without written authorization from XyleHosting
• Circumventing resource limits, rate limits, or security controls
• Using our infrastructure for any activity that violates applicable laws in Nepal, India, Singapore, Germany, or your jurisdiction

3. Service Limitations & SLA

3.1 Uptime Guarantee

XyleHosting guarantees 99.9% network uptime for all services, measured monthly. This excludes scheduled maintenance windows (announced at least 24 hours in advance), force majeure events, and downtime caused by customer actions. Current network status is available at status.xyle.host.

3.2 Resource Limits

Each hosting plan includes specified resource allocations (RAM, CPU, storage, bandwidth). Consistently exceeding your plan's limits may result in service throttling or suspension. We will notify you before taking action and offer upgrade options.

3.3 Backups

While XyleHosting provides automatic daily backups on eligible plans, you are ultimately responsible for maintaining your own backups. We strongly recommend downloading your own copies of critical data regularly. Backup restoration is provided on a best-effort basis.

4. Billing & Payment

• Services are billed in advance on a monthly or quarterly cycle as selected at checkout.
• Invoices are sent to your registered email address before the due date.
• Payment is due within 7 days of invoice generation. Services may be suspended after 7 days of non-payment.
• Prices are listed in USD. XyleHosting reserves the right to adjust pricing with 30 days' advance notice.
• All payments are non-refundable except as specified in our Refund Policy.

5. Suspension & Termination

5.1 Suspension Conditions

We may suspend your service immediately and without prior notice if:

• Your server is actively involved in a DDoS attack or network abuse
• Illegal content is detected on your service
• Your account poses an immediate security risk to our infrastructure or other customers
• Non-payment after the 7-day grace period

5.2 Termination by Customer

You may cancel your service at any time via the billing portal. Cancellation takes effect at the end of the current billing period. Please download all your data before cancelling, as we delete server content within 7 days of termination.

6. Limitation of Liability

To the maximum extent permitted by applicable law, XyleHosting's total liability for any claim arising from your use of our services shall not exceed the amount you paid in the three months preceding the claim. XyleHosting is not liable for indirect, incidental, or consequential damages, including lost profits or data loss.

7. Changes to Terms

We may update these Terms at any time. We will notify you by email or site notice at least 14 days before significant changes take effect. Continued use after the effective date constitutes acceptance.
